摘要:	由於科技發展趨勢致全球健康照護產業型態發生變化，健康照護服務方式已從傳統醫院臨床服務，轉而以慢性病的居家照護與生活服務為主軸，並以預防保健的角度來思考健康照護體系的發展。「遠距健康照護」係結合醫療照護、資訊技術、電子化醫療器材等跨領域專業，讓民眾在熟悉的社區與居家環境中獲得健康照護與預防保健等服務。隨著資訊技術的演變，遠距健康照護服務的範圍、應用也隨之擴張，甚至已有許多民眾主動使用記錄自身健康資料的應用軟體作為健康管理、促進健康之用。然而，我國自2012年10月1日施行個人資料保護法後，遠距健康照護相關的規範並未有配合現況增修，且分散於諸多法令中，以致遠距健康照護的使用者或相關產業發展及應用上難以遵循，令使用者承受許多安全與隱私上之風險，相關產業發展也恐違反法令而窒礙難行。本研究透過文獻分析及德爾菲法(Delphi Method)以問卷方式蒐集各專家意見，發現專家對於各議題之一致性與重要性均達中高以上的分數，顯示我國個人健康資料隱私權於遠距健康照護之強化方向明確且重要。 Due to scientific and technological development led to the global health care industry change. Health care services from the traditional way of hospital clinical services , turn to chronic home care and living services for the spindle. And began to preventive health care perspective to think about the development of the health care system." Telehealth care " is a combination of medical care, information technology, electronic medical equipment, and other cross-cutting professional. It allows people get health care and preventive health care services in the community and familiar environment. With the evolution of information technology, remote health care services range , the application also will expand. There are many people and even automatically record their own health information management application software as health, health promotion purposes. The regulations of health care do not have upgrading with the status and dispersed in many fragment, after Personal Data Protection Act come into force as of October 1, 2012.This is difficult to follow the development of health care industries and the user or application telehealth care. Many users endure the risk of security and privacy. Development of related industries maybe also violate the regulation and difficult to follow up. In this study, we will collect the expert opinion on by a questionnaire with the Delphi method (Delphi Method) and comparative law analysis. Through this research to find out the problems of personal health information privacy or a strengthen way of the law in our telehealth care.
