Abstract:	隨著社會進步，弱勢團體與老人的福利以及長照議題逐漸受到重視，而身心障礙者是比老人更需要被重視與發掘的族群。以往對於身心障礙議題之研究少有從服務提供者角度出發，因此本研究提供不同於以往之觀點，旨在探討身心障礙教養機構面臨之困境，並試圖尋求解決之道。本研究對象為11所內政部登記有案之公私立教養機構，以立意取樣方式選取樣本，使用質性研究之深度訪談法收集研究資料，透過紮根理論法進行歸納與分析。研究結果顯示，身心障礙教養機構面臨之困境相當多樣化，對於身心障礙者也邁入高齡化的現象，政府與民間皆尚未有適切之因應策略，而衍生出來的信託議題亦有待進一步的規劃與加強。機構方面，缺乏精神障礙合併其他障別之收容機構，造成身障者權益受損以及管理上的衝擊，常見之大型化教養中心亦不符合近年來強調的社區化理念。法規方面，對於服務提供者的保護不夠，多項規定之彈性亦顯得不足，法條是否淪為空談也是問題之ㄧ。整體而言，欲舒緩身心障礙教養機構面臨之困境需要政府與民間的相互合作，政府方面可透過落實相關法規、成立高齡或其他特殊需求之機構、增加法規彈性等方式給予協助，而民間團體則可持續推廣信託工作，並且舉辦經驗分享聚會，邀請政府專家學者進入體系之中共同討論，使理論與實務得以相互配合，共同突破現有之困境。 Objective: The welfare of disadvantaged should be paid much attention to. There are few studies about disabled people have sentiments on service providers, so this study will provide a different viewpoint about the issue on disabled people. The purpose of this study is to discover what predicaments which care centers of disabled people faced and try to surmount them. Methods: The study subjects were 11 institutions from 254 organizations for disabled people which registered on Ministry Of The Interior selected by purposive and snow ball sampling. The data were collected by in-depth interview and analyzed by qualitative way which based on grounded theory. Results: Results of this study showed that the predicaments which care centers of disabled people faced were diversiform, including profasional services, administrative management, personnel management, aspect of laws and the concept on the society. Conclusion: The predicaments were not only interior but connected to the society. Disabled people in aging society, the issue of trust and the law is not flexible tormented with the institution for disabled people. To reduce these predicaments, the government should administer the law assuredly and in non-governmental circles should hold some meetings to share different experiences and to invite a government representative to participate in this system.
